Four Statutory Conditions for Lawful Presence of Dogs on Food Premises
| (1) | Permission: | Food premises must be granted the "Permission for presence of dogs on food premises" by the DFEH |
| (2) | Dog breeds: | Dogs entering the food premises must not be "fighting dogs" or "Known Dangerous Dogs" and any crossbreeds of fighting dogs |
| (3) | Control of dogs: |
(i) Must be securely held on a leash of not more than 1.5 m in length by an adult when the dog is present on the premises; or |
| (4) | Entry to the food room is strictly prohibited: | Dogs are not allowed to enter the food room (any food preparation space) at any time. |
Exemptions allowing Presence of Dogs on Food Premises (not subject to the new amendments)
✔ Dogs serving as guides (guide dogs) for a totally or partially blind person but they are still not allowed in the food room
✔ Dogs in connection with the exercise of a lawful power (e.g. police dogs, search and rescue dogs, etc.)
Penalties for contravention:
A maximum fine of $10,000,
imprisonment for 3 months and a daily fine of $300.
